Oriol Junqueras should be allowed to be MEP, states EU Advocate General

Oriol Junqueras should have been allowed to take up his position as an MEP, according to the Advocate General of the Court of Justice of the European Union (CJEU) in Luxembourg.

‘MEPs’ parliamentary mandate is acquired solely from the electorate and is not conditional on the completion of any subsequent formality’ – and therefore that Oriol Junqueras should have been considered an MEP after the EU elections in May, according to the advocate general Maciej Szpunar.

The advocate general has said jailed leader Oriol Junqueras has the right to be a Member of the European Parliament, and that Spain’s Supreme Court cannot impede him from taking up his seat. However, the EU court is yet to make a final ruling in the coming months following the advocate’s advice.
