Judge orders trial of Madrid regional president’s partner for alleged tax fraud

A Madrid judge has rejected an attempt by the partner of Isabel Díaz Ayuso – the right-wing PP president of the Madrid regional government – to delay his trial for alleged tax fraud.

The judge investigating businessman Alberto González Amador (main image) has ordered him to stand trial for alleged crimes against the public treasury, falsification of commercial documents, continuous accounting fraud and participation in a criminal group.

Last year, Spanish media reported, based on leaked correspondence, that González Amador’s legal team had proposed a plea deal in which he would admit the alleged offences to avoid a trial and jail. Ayuso accused the PSOE socialist party of PM Pedro Sánchez of orchestrating the leak to damage her. ALSO READ: Spain’s Supreme Court confirms trial of country’s Attorney General will go ahead.

In a ruling dated Monday, Madrid’s Court of Instruction No.19 confirmed the opening of trial proceedings against González Amador for allegedly defrauding the tax authorities of €350,951 through a scheme of false invoices. He allegedly acted as a commission agent with other businessmen during the purchase of face masks at the height of the Coronavirus pandemic. 

Judge Carmen Rodríguez Medel did not impose precautionary measures but added two further charges – continuous accounting fraud and membership of a criminal group – beyond those determined by her predecessor, Judge María Inmaculada Iglesias, who indicted González Amador last August. These additional charges were requested by the ‘people’s prosecutions’ brought by Más Madrid and the PSOE political parties. The magistrate has also ordered four other businessmen to stand trial for the same alleged offences.

The judge stressed that ‘the ruling to open oral proceedings merely serves to allow the case to go forward’, based on ‘the facts set out in the three indictments filed’, and that ‘its purpose is to assess whether the accusation is consistent, so as to prevent unfounded charges and the so-called ‘punishment of the dock”.

According to the ruling, both the Public Prosecutor’s Office and the State Attorney’s Office are seeking three years and nine months in prison for González Amador, as well as fines of €624,402 and €488,927. They consider him the main perpetrator, while classifying the other defendants as necessary accomplices in crimes against the public treasury.

By contrast, the Más Madrid and PSOE accusations also seek convictions for continuous accounting fraud and membership of a criminal group, which would carry five years in prison and an additional €27,000 fine.

The investigation originated with a complaint filed by the Prosecutor’s Office after it received a 2022 report from Spain’s Tax Agency citing possible irregularities involving the company Maxwell Cremona Ingeniería y Procesos Sociedad para el Fomento del Medioambiente.

According to the complaint, the Tax Agency detected ‘fictitious expenses based on invoices issued by various companies’. These were allegedly ‘expenses unrelated to any real services provided, all with the aim of paying the Treasury less than was owed under corporate tax for fiscal years 2020 and 2021’, the complaint stated.

The probe therefore focused on indications of corporate tax crimes for those years, with amounts exceeding €120,000. He is also charged with falsifying documents by submitting invoices for services never rendered, intended to reduce his tax liability.

On 24 February, González Amador refused to testify before the judge, invoking his right to remain silent on the advice of his lawyers until a separate pending case was resolved.

His legal team had appealed his indictment before the Madrid Provincial Court. However, on Monday the judge rejected suspending the case. 

Nevertheless, González Amador could still avoid trial if the Provincial Court ultimately upholds his appeal.
